§ 3.52.170. Exclusions.

The provisions of this chapter shall not apply to the following:

(1)

Any person, firm or corporation buying and selling furniture and household goods, known as secondhand furniture dealers, or to those engaged in and commonly known as secondhand bookstores;

(2)

Collecting/selling by nonprofit corporations;

(3)

Auctions by licensed auctioneers;

(4)

Any events where sale of items does not exceed ninety-six (96) consecutive hours of duration, including, but not limited to, flea markets, fairs, conventions, hobby shows;

(5)

Wholesaling or dealer to dealer sales of merchandise;

(6)

Any sale held on property occupied as a dwelling by the seller, such as a garage sale, yard sale or moving sale.
