§ 3.08.035. Prior approval of building permits.

  • Prior to applying for a building permit to construct, alter or expand a liquor licensed establishment, the licensee or its agent shall request and receive a preliminary approval from the city clerk that the proposed construction, alteration or expansion is in compliance with this chapter. Any party aggrieved by such a determination may within fourteen (14) days appeal said determination to the city council by filing written notice of said appeal with the city clerk. The council shall then conduct a hearing on the matter within thirty (30) days and render its decision. This decision shall become final unless appealed to the district court within thirty (30) days of the date made.
